If the Supreme Court concludes that the sentence of the appeal trial, which found the stepson’s murder charges innocent, is incorrect, there is a possibility that the sentence will be different in pretrial detention for destruction.
However, the legal community believes that the possibility that the innocence of the first and second trials will be annulled due to fault is low. The appeal trial of the Supreme Court is not a factual trial, but a judicial review, not a new trial on the facts, but it judges whether the legal interpretation in the previous trial was correct based on the evidence and testimonies previously presented.
In fact, it is very likely that the Supreme Court will issue the same judgment, as the first and second trials conclude that it is difficult to admit the murder charges of Mr. Ko’s stepson based on the evidence presented by the prosecution to the court.
