A bill (Employment Insurance Law, Workers’ Compensation Insurance Law and amendments to the Collection Law) was approved by the National Assembly on the 9th to expand the application of employment insurance and compensation insurance of industrial accidents for 14 special types of (especially high) jobs of workers, including package delivery workers.
The National Assembly this afternoon held the last plenary session of the ordinary National Assembly and voted on the amendments to the Employment Insurance Law, the Work Accident Insurance Law and the Collection Law, the so-called ‘Special Law 3’.
The amendment to the Employment Insurance Law was approved with 253 registered members, 239 in favor, 4 against and 10 abstentions. The amendment to the Work Accident Insurance Law was approved with 252 registered members, 236 in favor, 1 objection and 15 abstentions. The revised bill for the Employment and Work Accident Insurance Collection Law was approved with 249 members, 232 in favor, 3 against, and 14 abstentions.
The main point of the amendment to the Employment Insurance Act is to include ‘job providers’, such as special notices exposed to economic risks by the spread of Corona 19, as an employment insurance issue. Consequently, it included a plan to provide an amount equivalent to job search benefits and pay for prenatal leave, etc., and made it possible to request related data for insurance processing from the platform worker’s employer.
However, considering the characteristics of some industries where it is difficult to identify income, it was decided to expand the goal in stages. It was decided to delegate the objective and the time of application to the execution decree. The effective date of the amendment is July 1, 2021, but it applies from January 1, 2022 to platform workers.
The amendment to the Work Accident Insurance Law is intended to extend the application of work accident insurance to special notices while maintaining the “system for requesting exclusion from work accident insurance coverage”, but strictly limiting the reasons of request.
The workers compensation insurance exemption application is a system that can be applied if the worker does not want to apply the law, but it has been controversial because it was known that courier workers who died from overwork this year were forced to apply by their employers.
The amendment specifies the reasons for requesting exemption from the industrial accident insurance application as △ If an especially tall worker is closed for more than a month due to illness, Busan, pregnancy, childbirth or childcare △ If a worker of a special high school is closed for more than a month due to reasons attributable to the owner of the company △ If prescribed by the Presidential Decree made.
The effective date of the bill is July 1, 2021 and it applies to special workers who are already excluded from the application. Special workers who wish to request exclusion for the reasons contained in the amendment must request a new one.
The revised bill of the Collection Law reorganized the parties that are linked according to the revision of the Employment Insurance Law and the Work Accident Insurance Law.
