The prosecution requested an arrest warrant for Chung Jeong-soon (equivalent to Cheongju) of the Democratic Party, who is accused of violating the Public Office Election Law.
Prosecutor’s Office investigates alleged violations of electoral law
Assemblyman Chung delayed attendance for reasons such as the National Assembly calendar
A court order can be issued only with the consent of the National Assembly
The Cheongju District Prosecutor’s Office announced on the 28th that it had requested an arrest warrant against Chung for violating the Public Office Election Law, the Political Fund Law and the Personal Information Protection Law. The prosecution said: “As Congressman Chung refused to comply with several requests for assistance since mid-August, he requested an arrest warrant in consideration of the statute of limitations of the prosecution (October 15).”
Representative Jung did not respond to the date of service of the subpoena on the 26th after delaying the investigation several times due to the wedding of his children and the National Assembly schedule. The Cheongju District Prosecutor’s Office did not reveal how many times he requested to attend.
In the course of the general elections of 4 · 15, Chung is suspected of accounting fraud. On June 11, Mr. A, who was previously in charge of accounting for the electoral field, sued the prosecution on June 11, alleging that there were a series of accounting irregularities during the electoral process. Mr. A also provided data such as ledgers, political funds, donations, and recording files on his mobile phone to the prosecution.
In the process of investigating this, it is known that the prosecution detected the situation where the money from the Cheongju City Councilor, etc., flowed to the legislator Chung. Congressman Chung is also accused of leaking the list of volunteers during the electoral process. The prosecution estimates that on February 26, Chung received personal information on 31,000 volunteers from a considerable number of C volunteers, a former Cheongju Volunteer Center, through his deputy secretary and niece B.
On the 14th of last month, the prosecution charged Mr. B and Mr. C on charges of violating the Public Positions Election Law and pointed to the relationship between Mr. B as an accomplice.
To issue an arrest warrant against Congressman Chung, he must go through the consent procedure before the National Assembly. Active members of the National Assembly, unless current violators, are not arrested or detained without the consent of the National Assembly during the session, or even if they are arrested or detained before the session, have the privilege of not being arrested .
The judge of the competent court who has received the request for the arrest warrant submits a request for consent to the arrest to the government in accordance with Article 26 of the National Assembly Law, and the government follows the consent request procedure for the arrest of the National Assembly. The president of the National Assembly must report this to the nearest plenary session and vote on the arrest motion within 72 hours after 24 hours. According to the National Assembly calendar, the next plenary session is the closest date to the next plenary session, so it seems difficult to vote on a motion to arrest Chung within the statute of limitations of the electoral law.
In this case, the punishment for the violation of the Law of Election of Public Officials becomes impossible. However, the statute of limitations of the Political Fund Law and the Personal Information Protection Law is sufficient. The prosecution said: “It is a matter that is being investigated, so I cannot give you more details.”
