The US International Trade Commission (ITC) issued the final opinion on the lawsuit for violation of trade secrets of electric vehicle batteries by LG Energy Solutions and SK Innovation.
In the final ITC opinion, presented on 4 (local time), SK Innovation announced the information of the list of materials sl predispersion grout △ mixture and recipe of cathode / anode △ double layer coating △ finishing of the bag of LG Energy Solutions battery △ finish of the battery bag, etc. has been described as a breach of 22 trade secrets in the domain.
ITC said: “Without LG’s trade secrets, it was clear that SK would not have been able to develop the information in 10 years and therefore issued an import ban for 10 years.” It was done with blatant malice. “
The report also noted that SK Innovation used the trade secrets of LG Energy Solutions before obtaining an order for Volkswagen’s MEB platform battery in 2018. At the time, SK said that it had won the order by acquiring pricing information from its competitors, which is a trade secret, and offer it to Volkswagen at the lowest price.
Han Woong-jae, head of legal department at LG Energy Solutions, said: “Because the basic position is coexistence (of the K battery industry), we first suggested resuming negotiations with SK, but we have not received no reaction or proposal. for a month. “We have no choice but to deal faithfully with the ongoing lawsuit in the United States.” Furthermore, with respect to the settlement fund, which has not been able to reduce the difference of opinions in terms of ‘trillions’, it can be inferred that competitors have made unfair profits as much as the amount of investment (5.3 billion won) spent on I + D for the last 10 years.
However, SK Innovation is still unable to acknowledge the ITC’s final opinion. An SK Innovation official said: “LG Energy Solutions, which filed a trade secret infringement lawsuit, did not provide evidence and there is no evidence of trade secret infringement, the essence of this issue.” He said: “Independent battery development for more than 40 years. We have been working on it and we are making safe batteries that have never had a fire until now.”
Currently, SK Innovation has made a formal request to the White House in the United States to intervene in the final judgment of the ITC. The President of the United States, Joe Biden, can dismiss the decision of the ITC within 60 days if he considers that the purposes of public interest should be taken into account.
