A 40-year-old man sentenced to prison for committing a so-called “ don’t ask assault ” by crushing the head of a teenage girl who saw him for the first time feeling bad after work.
On the 8th, the Bucheon Section of the Incheon District Court, the first criminal division (the presiding judge Im Hae-ji), sentenced Mr. A (44), accused of attempted murder, to three years in prison .
Mr. A was charged with trying to kill Mr. B (19), who first saw him on the street around 0:49 am on September 16 last year, after going to the women’s bathroom in a building in the town of Bucheon and hit his head with a brick five times.
Mr. A’s crime was stopped by a PC cafeteria employee who ran after hearing B’s cry: “Please help.”
A was found to have “Don’t Ask” against an unspecified woman who was angry when she had to change jobs while thinking she had been treated unfairly at work.
Previously, in 1997, Mr. A was sentenced to 1 year and 6 months in prison and 3 years of probation for inflicting a skull fracture by striking the head of the victim with a brick.
At trial, Mr. A argued: “It is true that he hit the victim with bricks, but there was no intent to murder.”
However, the judge emphasized that “the intent to kill is not recognized only if there is an intentional purpose or intention, and if it predicts the possibility or danger of death from events such as assault, it will be recognized.”
“The defendant ran to the women’s restroom at night and prepared a broken brick for a sidewalk block that would be difficult for a grown man to hold in one hand. Considering that the priced part is also the head, the intent of the murder is sufficient. It is admitted. “
The judge said: “The defendant did not ask a one-sided woman just because she was in a bad mood. We considered the termination,” revealed the reason for the sentence.
