The one-year, four-month sentence was upheld by Yoo Si-young, a former president of Yusung Enterprises, who was accused of harming the company by using company money to destroy the union.
Supreme Court Division 3 (Judge Kim Jae-hyung) announced that it will end the centuries in which the death penalty was imposed on three people, including former President Yoo Si-young, accused of violating laws related to aggravated punishment for certain economic crimes.
Previously, President Yoo Jeon and others were handed over to trial in February last year for allegedly paying 1.3 billion won in round-trip money more than 24 times by requesting a strategy to destroy the union for a creative consultation. When they were investigated for union destruction, they were also accused of using the company’s 150 million won funds five times as personal lawyer fees.
The first trial said, “Especially, the defendant Yoo Si-young is the final decision maker and the director of the company, and the fault is great and the possibility of fault is high.” He sentenced the former president to 1 year and 10 months in prison and a fine of 5 million won. Executives Choi Mu-gae and Lee Mu-gae were sentenced to three years of probation in one year, four months, and one year and two months, respectively. The first trial admitted the alleged embezzlement, saying, “When we were charged with past unfair labor practices and were tried, the company paid attorneys’ fees to defend the individual criminal case.”
On the other hand, the Court of Appeals and Appeals recognized that President Yoo Jeon spent the company’s funds and harmed the company and workers, but reduced the sentence by judging innocence for the cost of the appointment for a “ company oil company ” instead of the individual of the accused. The Court of Appeals sentenced President Yu to one year and four months and a fine of 5 million won. Choi and Lee were sentenced to one year in prison, three million won in fines and ten months in prison.
Meanwhile, the First Division Supreme Court (Chief Justice Judge Kim Suk-ju) upheld the centrifugal sentence sentenced to five years in prison for two years in prison by five members of the Yooseong branch, who were prosecuted by a “court case in charge of labor affairs for a Yooseong company” in Asan, Chungnam, in November 2018. Previously, the first trial sentenced two trade unionists to one year and ten months in prison, respectively, and the other three sentenced them to probation, while the appeals court lifted the sentence in January to two years and one year and six months.
“The secondary court ruled more vigorously, including sentenced to death by workers who had been suspended in business matters with Kim Mu-gae, while commuting for a case in which President Yu was charged. The Supreme Court upheld the ruling today: “It is a shame that the Supreme Court has not corrected the second trial.” The metal union said in a comment: “The Supreme Court ruling confirmed that the capitalist’s frivolous perception that” house money is my money and that I can do whatever I want “can no longer adhere to our society” . A Yusung Enterprise official said, “There is no position to be disclosed.”
