The special counsel asked the court to sentence Governor Kim to six years in prison in the appeal hearing decision. He was sentenced to 3 years and 6 months in prison for obstruction of work and 2 years and 6 months in prison for violating the Law on the Election of Public Officials. In the first trial, the imprisonment ordered by the special prosecutor was one year longer than the five years in prison. The special prosecutor said: “In the 2017 presidential elections and the 2018 local elections, the process of illegal participation in public opinion polls and undermining the fairness of the elections was clearly revealed.” He insisted.

On the other hand, Governor Kim asked, “If what the special counsel wants is not to reveal the truth of this case, is he unconditionally holding Kim Gyeong-soo guilty?” Innocence claimed.

If Governor Kim is sentenced to a fine of 1 million won or more for Public Officials Election Act charges and it is confirmed, the right to elect will be restricted for five years. If you are sentenced to prison, you are limited to 10 years. If charges related to the Public Officials Elections Act are found guilty at the first trial and then at the second trial, Governor Kim’s challenge for the presidency becomes virtually difficult.

Even if the charges of violating the Public Officials Election Act are not found guilty, if you are sentenced to prison for obstruction of work, you will lose your position as governor under the Public Officials Act. Even if you receive a trial period, you cannot run for election during the trial period.

At the first trial, Governor Kim was sentenced to two years in prison for obstructing jobs with disabilities, such as computers, and two years in prison in October for violating the Public Office Election Act. Governor Kim was arrested in court and released on bail during the second trial in April last year.
