Gyeongnam Governor Kim Kyung-soo, who was sentenced to prison in the first trial for the ‘starter case’, was sentenced to an appeal trial a day earlier. Governor Kim’s appeal hearing will be held at 2 pm on the 6th at the Seoul High Court Criminal Division 2 hearing. It is a sentence that is issued 22 months after the decision of the first trial on January 30 of last year.
Since approximately November 2016, Governor Kim was accused of illegally manipulating public opinion by using the ‘King Crab’ for the election of President Moon Jae-in, who was a Democratic presidential candidate in cooperation with the ‘Draoking’ Kim Dong-won and his party. There is also a suspicion of proposing the post of Consul General in Sendai to Mr. Kim in exchange for helping with local elections (Election of Public Offices Act).
In January last year, the first trial sentenced him to two years in prison for obstructing jobs with disabilities such as computers and two years in prison for violating the Public Office Elections Act. Governor Kim was detained in court but was released on bail in April last year and was tried without custody.
Governor Kim’s appeal sentencing was initially scheduled for January, but the allegations were resumed on the grounds that an additional hearing was necessary. After that, the sentencing was delayed by about 10 months from the original schedule, as regular court greetings were honored. The special prosecutor has requested 6 years in prison (3 years and 6 months for obstruction of work with disabilities such as computers and 2 years and 6 months for violation of the Election of Public Officials Law), which is longer than the first trial.
In the appeal trial, the key question is expected to be whether or not to attend the ‘King Crab Demonstration’, which the judge reached an interim conclusion. The special counsel believes that Governor Kim ordered the large-scale development after seeing the King Crab rally when visiting Kim’s office in Paju, Gyeonggi Province, on November 9, 2016. On the other hand, Governor Kim admitted who went to the office at the time, but insisted that he did not see the demonstration due to the meals. To prove it, he added additional testimony to the president of the Dakgalbi house he visited.
Additionally, the question is likely to be whether ▶ a joint criminal relationship with Mr. Kim will be recognized. ▶ Whether the prosecution of proposing the position of Consul General to Sendai to Mr. Kim’s assistant may be considered a violation of the Public Officials Elections Act.
Meanwhile, Governor Kim personally held a briefing on the current situation of Corona 19 in Tokyo this morning and met with journalists, saying: “It does not seem appropriate to discuss the results of the trial at this time. Please watch.”
