The trial of the vice president of Samsung Electronics, Lee Jae-yong, for the repatriation of Kukjeong Nongdan will start again tomorrow (26). When the court first mentioned the need for the compliance system and indicated that it would be reflected in the ruling, Samsung immediately accepted the lawsuit and created a compliance committee. However, with the final dismissal of the challenge in the Supreme Court, the trial was held again after nine months. In the final trial, the court announced that it would appoint three professional judges to verify the performance of the Compliance Committee, and in this regard, a date of preparation for the trial was held. However, before this preparation date, the court appoints former constitutional judge Kang Il-won as a professional judge. Unlike Vice President Lee Jae-yong’s side, when the special counsel did not recommend candidates, the court decided to appoint only professional judges. The special prosecutors rebelled. In appointing expert judges and deciding on evaluation matters, he said that the opinions of prosecutors and special attorneys were heard and the decision was also notified to both parties, but not all these procedures were followed. They also argued that the special prosecution was excluded from the entire process, such as giving opinions on evaluation elements only from the accused side. The special prosecutor finally issued a request to cancel the appointment of a professional judge, and will propose to restart the procedure from the beginning in tomorrow’s trial (26). Although it is the trial preparation date that the defendant is not required to attend, the court will send a summons and Vice President Lee Jae-yong will also appear in court. On the other hand, the trial on the alleged illegal succession of management rights by Vice President Lee accused by the prosecutor’s office last month will open a second date of preparation of the trial in January of next year, and then will proceed with the judicial process.
