Former President Park was put on trial in April 2017 in the Gukjeong Nongdan case. In August of last year, the Supreme Court canceled and returned former President Park’s case in an appeal ruling. According to the Law on the Election of Public Officials, if the president is accused of bribery in connection with his functions while in office or is subject to an aggravated penalty under the Special Bribery Law, this crime and other crimes must be sanctioned separately. However, the case was re-tried by the higher court, as neither the first nor the second trial were sentenced separately.
In addition to the Gukjeong Nongdan case, former President Park was also on trial on charges of receiving special activities expenses from former NIS bosses Nam Jae-joon, Lee Byung-ki and Lee Byung-ho (bribery and loss of treasury). . The Sixth Criminal Division of the Seoul High Court (Presiding Judge Oh Seok-joon), which was in charge of repatriation for destruction, tried the two cases together and sentenced former President Park to 20 years in prison in July. In connection with the bribery charges in the charge, a fine of 18 billion won for 15 years in prison and 5 years in prison and an additional penalty of 3.5 billion won for other charges such as abuse of authority, duress and loss of the national treasure.
At the time, the judge explained that on grounds of the sentence, “there was little personal gain for former President Park, and it was the same situation as when he was politically sentenced to bankruptcy.” He added: “If the judgment of the appeals court is carried out as is, the age of former President Park was considered at the time the execution was scheduled to terminate.”
The prosecution again appealed the ruling and the repatriation judgment, and the Supreme Court’s decision arrives on the 14th of next month.
