After years of demanding that stalking crimes be severely punished, the Council of State passed legislation with heavy penalties.

The enactment of the Stalking Penalty Act stipulates that stalkers can be punished with a prison term of up to three years or a fine of up to 30 million won.

Previously, the penalty was only 100,000 won under the Misdemeanor Penalty Act, but now the level of punishment is increasing with the highest incarceration.

Procedures for the prevention and protection of victims are also strengthened.

Upon receiving a report of stalking, the police officer immediately takes emergency action on the scene and the chief of police can take action to deny access with the approval of the judge.

In case the concern is repeated, the prosecutor has allowed the court to request an action to temporarily detain a harasser in a detention center or detention center, either ex officio or at the request of the police.

He also clarified the definition of stalking crime.

It was captured as an act that caused anxiety or fear in the victim by repeatedly following the victim’s will, watching the house, contacting the cell phone, sending something or leaving it at home.

The Ministry of Justice explained the reason for the enactment of the Penalties Law, noting that stalking is an act that causes serious harm to the victims, but that there are no penalties under current law, which entails serious crimes such as murder.

Legislation for the Stalking Penalty Law, which was approved at the Council of State meeting, is expected to be presented to the National Assembly within this year after approval by the President.

The government also decided to introduce a specific investigation system that appoints a prosecutor and a police officer dedicated to the professional investigation and response of stalking crimes.
