The National Human Rights Commission decided that what the army determined to be disability was a human rights violation and dismissed a noncommissioned officer who had undergone a sex change operation. There is no legal basis for gender change surgery to be considered a mental and physical disorder. The army said it would not cancel the campaign, saying there were no problems. Reporter Kim Kyung-soo reports. Former Sergeant Byun Hee-soo, who took off his military uniform after undergoing sex change surgery while on vacation. At the time, the military decided that Sergeant Byeon was not allowed to serve in the military because he had a level 3 physical and mental disability under the Military Justice Act. However, the National Human Rights Commission decided that this provision was a violation of human rights by the public authority. There is no legal basis for applying mental and physical disabilities because Sergeant Byun did not have an accident but instead performed surgery based on gender identity. The Human Rights Commission will also advise the Minister of Defense and the Army Chief of Staff to improve the system and make corrections. The Military Center for Human Rights, which filed a complaint with the NHRCK saying that the forced dismissal action was discrimination, is a prudent position while giving meaning to this decision. This is because there is a precedent that the recommendation of the Human Rights Commission to postpone Sergeant Byun’s assessment of the entire country really just did. Regarding the NHRCK’s decision, the military stated that there was no problem with Sergeant Byun Hee-soo’s discharge order. He said there is no plan to cancel the provision and that legality will be recognized in an ongoing administrative lawsuit.
