Civilian divers who participated in the rescue operation at the time of the Sewol ferry sued and lost lawsuits declaring that the class of injuries was unfair.

The Seoul Administrative Court Administration Division 5 (Judge Yang Joon Park) announced on the 10th that during the Sewol broadcast, eight civilians, including Mr. A, filed a lawsuit against the National Police Agency for canceling the provision of the injury rating decision.

Mr. A and others participated in victim search and rescue activities from April 16, 2014 until the day of the disaster. They applied for compensation for relief work in August 2016. After the Sewol ferry disaster, the law was revised and compensation was paid for injuries that are not physically disabled since July of that year.

Haekyung discussed their qualifications through a subcommittee under the Central Maritime Disaster Relief Response Committee and reported the results. However, Mr. A and others filed a lawsuit alleging that Haekyung lacked “bloodless necrosis of bone” in the rating. At that time, there was a decompression procedure that had to be done when leaving the water, and a repeated dive without enough rest.

The court dismissed Mr. A’s claim as inappropriate because it did not meet the requirements. The Central Task Force raised the injury grade from 7th to 5th in consideration of Mr. A’s objection and increased the amount of compensation by approximately 64 million won.

For the rest of the people, he said, “It is admitted that I was hospitalized for avascular necrosis.”

The courts heard the results of the evaluation of medical records by professional medical institutions and the Korean Society for Medicine of the Working Environment. “It is highly likely that manuscripts with a minimum of 14 years of diving experience have already had bone necrosis before the rescue operation is performed.”

Furthermore, it was based on the fact that the two members of the Central Task Force Sub-Clinic did not recognize the causal relationship between the two, and that even among rescuers who had been rescued longer than these, they did not produced bone necrosis.
