Clarifications for forced reductions rent 40% or 100% primarily related to professional leases gives a new decision of the co-responsible ministers.
This is the joint decision number 1059 / 19-3-2021 of the ministers Finance, Development, Manpower and Transportation, Chr. Staikoura, A. Georgiadi, K. Hatzidaki and I. Plakiotaki, who according to an article in the newspaper “Eleftheros Typos”, will have retroactive effect from March 2020, when the provisions for rent reduction came into force.
The new configuration points for rent reductions, which are retroactively effective as of March 2020 and must be specially cared for by owners and tenants, are the following:
1. For the application of the provisions on reductions or non-payment of rents of professional housing, commercial and the leases to be installed are understood as commercial. canteens or bars and other companies that operate within:
* premises owned or used by the public services of the ministries or sublet by them, as well as the interior of the buildings that house their services,
* Municipal public areas, sports centers and gyms, which are owned or used by Local Government Organizations and their legal entities, as well as the interior of buildings that house structures or services of local authorities and their NPDD.
2. The provisions for the reduction or non-payment of the rent of commercial housing will also apply in the following cases:
* business (merchants) who have entered into a contract for the use of an agreed space (store) within points of sale, shopping centers or discount villages,
* natural and legal persons or legal entities that pay in exchange for the lease / concession of the use of the right to operate a stand,
* Professional leases in which the lessee is a non-profit private law legal entity (NPID).
3. In case the conditions are met non-payment of professional rent and the rent has been paid before the month for which the payment exemption is established, 100% of the rent for which the tenant is released from the payment obligation is offset in subsequent rental payments. In the absence of subsequent rent payments due to termination of the employment relationship, the exemption amounts are requested as amounts improperly paid.
4. Provisions for rent reductions or exemption of the rental payment of the professional home are also valid for cases in which use is made beyond the contractual duration of the rental of the property (non-contractual use) and compensation is paid for the use, in accordance with the current provisions of the Civil Code.
5. Provisions on rent reductions or exemption from professional rent payments. do not apply:
* when there is a lease contract that includes as a condition the payment of a monthly rent as a percentage of income, unless the payment of a minimum monthly rent is provided,
* in the event that the leasing company is bankrupt, inactive, suspended due to intra-community transactions or does not have an operating license or has been revoked.
