Prosecutor Adamantia Oikonomou proposed to the court to suspend the execution of the sentence for the leading political group ATHEX and those sentenced to severe penalties for ATHEX’s criminal acts.
The prosecutor separated only Giorgos Roupakias, who has a life sentence and 14 years for the brutal murder of Pavlos Fyssas, since the law does not allow the suspension of the sentence of those who have a life sentence.
The prosecutor based her proposal on the fact that, as she argued, those convicted to date have complied with the restrictive conditions imposed by the Greek justice, without ever violating them (others due to coercion), they have not carried out preparatory actions to make them suspect of escape, they were legally represented in court and are not suspected of committing new crimes, since the ATHEX party in which they joined and committed what is described in the indictment, no longer exists, has been dissolved and discredited.
“It turned out that the defendants had a known residence and met all the conditions imposed on them, without ceasing to comply with them. They appear for the hearing and are not suspected of having fled. It is not clear from any evidence that they are going to commit other crimes, “the prosecutor characteristically stated in her proposal, adding that the criminal records of most of the parliamentarians, with the exception of Nikos Michaloliakos, are clear.
“Before the Greek courts, citizens are equal and it doesn’t matter who they are … It should be noted that the Golden Dawn was dissolved, its offices and the newspaper were closed. “Regardless of the foregoing, the execution of the sentences is equivalent to irreparable damage since by the time the case is final they will have completed the sentence,” he emphasized and added that the law allows the suspension of the sentence but emphasizing that there are tests. It was found that the condemned have legal distribution, there were no defendants or violated the restrictive conditions of their stay. Even the defendants who were placed in pre-trial detention after their release were given restrictive conditions, some very strict, but they appeared before the Court. Some of them were presented to the audience. “Furthermore, they are not suspected of having fled,” said the prosecutor, noting that “they are awaiting the fair trial of their court and appeared when requested by their court.” He recalled, among other things, the “present” of former MPs Kasidiaris, Lagos and Mattheopoulos.
The court is not bound by the prosecutor’s proposal, which, however, has its significance, when formulated by a high-ranking prosecutor in such a historic trial and after 5.5 years of hearing.
The final decision of the court is expected, except unexpectedly, tomorrow Tuesday.
