The Prosecutor’s proposal

Previously, the prosecutor Adamantia Oikonomou demanded the mitigation of all those convicted of joining a criminal organization, who were not found guilty of another crime. However, he did not acknowledge any mitigation for the Golden Dawn lead team.

“The court ruled that the defendants joined a union of people who intended to commit serious crimes that affect democracy. So what mitigations can I suggest in this case? It would be contradictory, “he characteristically said during his speech.

Specifically, it rejects the mitigant recognition applications for Nikos Michaloliakos, Christos Pappas, Ilias Kasidiaris, Giannis Lagos, George Germeni, Elias Panagiotaros and Artemis Mattheopoulos. In other words, his proposal does not concern those guilty of running a criminal organization.

Initially, the prosecutor requested that the attenuation of legal life be recognized only for the former convicted deputies of Chrysi Avgi Stathis Boukouras, Dimitris Koukoutsis and Chrysovalantis Alexopoulos. The three former deputies have been convicted solely of the crime of affiliation to a criminal organization, which is not accompanied by any other criminal act. For the rest of the condemned, the prosecutor had requested the rejection of all mitigating circumstances.

However, after the deuterologies of the lawyers and the presentation of new applications, the prosecutor’s proposal changed.

Defense counsel objections

Ms. Oikonomou’s initial proposal sparked an explosion in the defense benches and the voices of the lawyers, who addressed the court, each saying the name of their client, indicating that they too belong to this case.

One of Nikos Michaloliakos and Eleni Zaroulia’s lawyers, Takis Michalolias, yelled:

When he returned to his seat and before the lawyers could speak, the prosecutor requested the relief granted to the three former deputies and any other defendant who was found guilty of belonging without having any other criminal act related to the organization.

At the proposal of the prosecutor and according to the provisions of the procedure, the floor is given to the defendant’s lawyers. It is emphasized that the final decision on the recognition or non-recognition of mitigation belongs to the court.

What does the Penal Code establish for sanctions

Under the Penal Code, Nikos Michaloliakos and the six other former members of the neo-Nazi group who were found guilty of leading and joining a criminal organization face sentences of five to fifteen years.

For the members of the organization, the recognition of mitigations reduces the penalty from 5 to 10 years to 1 to 5 years.

The Fyssa family is “present”
