Greece is obliged to pay the amount of 312,500 euros to the owner of a hotel that has been occupied for three years, according to a decision of the European Court of Human Rights.
The hotel’s owner, Aliki Papachela, had appealed to the European Court of Human Rights in the case of the occupation. The decision issued today justifies the owner of the hotel. The action concerned the property right.
According to the European Court of Justice, “in the case Papachelas and Amazon SA v. Greece, the court found a violation of the right to protection of property due to the possession, for more than three years, of the plaintiffs’ hotel by immigrants and a group of people acting out of solidarity with them “
At the same time, the court “ruled that Greece had to pay the plaintiffs 300,000 euros for the loss of employment (economic loss) and 2,500 euros for expenses.” He also had to pay Mrs. Papachela 10,000 euros for moral damages. “
Greece has been convicted of violating Article 1 of the First Additional Protocol to the European Convention on Human Rights (right to property). Greece has supported the inaction of the authorities, for reasons of public interest, at the risk of disturbing public order by evacuating dozens of people. The court acknowledged the concerns of the authorities, but ruled that this did not justify their three-year inaction.
The occupation of the closed City Plaza hotel in central Athens had started in April 2016. The occupation offered refuge to refugees and immigrants with the hotel owner requesting the evacuation of the occupation, claiming that it had caused financial problems. The occupation ended in July 2019, without police intervention.
