At today’s meeting, the Board of the Union of Judges and Prosecutors, by majority, consisting of Christos Nastas, President of the Court of Appeals, Nikos Salatas, Appeal, Margarita Stenioti, Appellant, Panagiotis Lydotiridikonis Prouperopoulos, Eporis Koferi, Grigoris, Dimitris Foukas, President of the Court of First Instance, Stathis Vergonis, Prosecutor of Appeals and Eleftheria Konsta, Appellant, made the following decisions:

1. Public health is a supreme good and a fundamental right, the protection of which, according to an explicit requirement of the Constitution (article 21, paragraph 3 S), is a primary obligation of the State and its safeguarding is the responsibility of the State and of all the citizens.

Due to the exceptional and unforeseen circumstances that have caused the pandemic in Greek society and the functioning of the judiciary, it is considered necessary to postpone for the autumn of this year the appointments of the Union of Judges and Prosecutors, which, according to the statute, every two years, during the months of May or June.

The Board of Directors, by majority, made this decision after taking into account: a) the fact that the measures against inconsistency are still being implemented and the measures to deal with the crown pandemic COVID-19 are still valid , while for reasons of avoiding demonstrations it is doubtful whether the trial of criminal cases will begin at the end of June and, in any case, the suspension of the operation of the courts will continue, perhaps with some additional exceptions, b) the fact that the case has not yet been specified. the place of its partial or total operation in the coming weeks, c) the protection of the excessive good of life, which does not allow to endanger the health of the judicial and fiscal officials and the secretaries participating in the elections, as well as their relatives. given that a large number of colleagues participate during the voting in the country’s great courts, where, in Athens, it amounts to around a thousand and in Thessaloniki almost four hundred d) the attitude of responsibility shown by the Judicial Council. in this critical period

2. In accordance with Article 8 of the Statutes of the Union of Judges and Prosecutors, the Board of Directors will be elected for a period of two years. In view of the fact that the Board of Directors elected on May 13 and 20, 2018 was formed on June 1, 2018 and its two-year term expires on June 1, 2020, the Board decided, by majority, to present a application for the appointment of a provisional administration before the competent court. , by all its members, in accordance with the Law due to the postponement of the elections. The competent court, when deciding on the application, will designate a new interim board of directors that will be solely responsible for carrying out the elections within the aforementioned period of time and that will deal only with urgent matters and that will be convened in accordance with Article 13. Statute.

We want the interim administration to conduct the elections within six months and indicatively mention the following dates: October 11, 2020 for all judicial districts except Athens and Piraeus and October 18, 2020 for the latter.

3. During today’s Board of Directors meeting, the President presented a document from EODY’s Department of Microbial Resistance and Infections with a proposed voting process during the conduct of the EDE elections. We consider that the Union cannot guarantee compliance with the instructions included in this document in the Courts of the Country and much more in the large courts (for example, disinfection and sealing of rooms, according to the EODY Protocol and not using them for seven days before elections, recruitment of specialized personnel for the entire State, who will ask questions about the appearance of symptoms with COVID-19, etc. In addition, instructions for compliance with the protective measures during the counting process are not included.

The impossibility, after all, of carrying out the elections within the month of June is demonstrated and agreed by those who do not have it. 175 / 9.4.2020 and 203 / 4.5.2020 documents to the Minister of Justice, by means of which the President of the Union, realizing the impossibility of carrying out the elections within the legal term, requests by legislative regulation the extension of the mandate of the current Board of Directors. . We would like to point out at this point the inadmissibility of the President’s initiative to seek, with the intervention of the Executive, the extension of the mandate of the Board of Directors of the Judicial Union in opposition to the constitutional principle of the Distinction of Functions.

4. In view of the conduct of the elections by the Provisional Board of Directors, which will emerge from the Court’s decision, the Board of Directors, at its current meeting, decided to take the following steps:

A) Instructs the Secretariat of the Union of Judges and Prosecutors to guarantee the registration of members, accounting records and expense documents, the filing of incoming and outgoing documents and the management codes of the website of our Union and the Sun. Outgoing presidency in what will emerge after the appointment of the interim administration.

B) Informs the Presidents of the Tripartite Boards of Directors and the Directors of the Courts and the Prosecutors’ Offices on the decision to postpone the holding of elections and the end of the mandate of this BoD on June 1, 2020, in accordance with the previous.

C) Informs the members of the Audit Committee of their obligation to carry out the required audits and to prepare the legal report provided for in Article 17, in view of the end of the mandate of the outgoing Board of Directors.

D) Inform the Secretary of our Union and Lawnet that it supports their websites for the above decisions and requests their faithful implementation.
