«A year has passed since the start of the pandemic, the courts remain closed to their essential functions, citizens do not receive adequate judicial protection and lawyers are in professional and financial despair, without the well-known “JMC of the weekend” prior ad hoc opinion of the scientific committee covid 19.
The Government continues to be a bystander to the problems of lawyers, its support for them is insufficient and it lags far behind the support received by other affected professions.
Even today, in the third phase of the pandemic, whose negative effects are multiplying, the Government has not taken measures to support lawyers, such as reducing the VAT rate in the Judiciary and increasing the VAT limit of 10,000 euros. . At 25,000 euros, the suspension of tax and insurance obligations and exemption from the performance fee, although the lawyers have, in fact, suspended their professional activity under the responsibility of the Government. Especially on the issue of VAT, which is directly related to the access of citizens, and in particular the financially vulnerable, to Justice and where there is a European obligation to comply with the country, we place their responsibilities to the sector to the Ministers of Finance and State for not solving it.
And as if all this were not enough, even in the payment of the grant of 400 euros from the OAED special account, which has been formed by the annual contributions of lawyers and other scientists, the methods of Minister K. Hatzidakis led the grant . to finally receive it only a small number of scientists (44,248 out of a total of 180,000) and the amount available will be barely 17.7 million euros, compared to 130 million, which is the reserve. The Government had to pay the grant to all beneficiaries, as promised.
The government’s behavior is extremely offensive to the judiciary. It hurt our dignity, it discredited us. And not only in terms of financial support but also in matters of an institutional nature, which are promoted without prior consultation with the Bar Association and without the participation of their representatives in the drafting committees.
The government in the eyes of lawyers has become unreliable.
Enough is enough. There is no longer room for tolerance.
The plenary session maintains in every sense that the dignity of lawyers is not negotiable. Those who try to hit it, in any way, will face the strong and coordinated attitude of the entire bar and at all levels. The struggles to date and the traditions of the bar are our legacy for the new struggles.
In this context, the Plenary decided to continue and scale the mobilizations with the following ACTIONS:
1. Request the resignation of the Minister of Labor and Social Affairs K. Hatzidakis, due to his unreliable and offensive behavior towards the bar association, on the subject of current insurance obligations, his handling of the OAED grant and the omission of a refund for Insurance Contributions previously withheld by EAF at source, through the 2020 legal fee promissory notes.
2. Propose to the Boards of Directors of the Bar Associations of the country the organization of “Days of panhellenic protest of lawyers”, with simultaneous meetings in the district in the courts and in Athens in the competent Ministries, on the days determined by the committee direction, respecting all prescribed prevention and protection measures.
3. Request the criminal investigation for the reserves of the special account OAED of the law 3986/2011.
4. Continue with the collection of protest signatures of lawyers nationwide.
5. Intensify the campaign on the Internet to highlight the government’s inconsistencies and its general attitude towards lawyers.».
