The 41 judicial officials underline in their letter that the SAD “It goes beyond its ends, making suggestions to the State under the guise of defending human rights” and notice that “The representatives of the Union had an obligation with their members to keep intact the image of impartiality and objectivity of their members and this obligation was not fulfilled.”
In fact, in their letter, the 41 indicate what are the responsibilities of the State and what are the responsibilities of judges and what are the limits of these two powers, noting the following:
“The careful evaluation of the sentences we impose, as well as the option to prohibit the meetings of more than one person in order to protect the good of human life and health in the midst of a pandemic, belongs to the state.

“Our participation in these issues for any other reason damages our prestige, our credibility and our independence and degrades the very administration of justice.”

The main purpose of the Association of Judges and Prosecutors, according to its statutes, is to guarantee the independence of judicial officials and improve the conditions for the administration of justice.
The signatories of this text have spent decades supporting these objectives as active members of the Union, wanting to contribute to its success, but without joining any of the various formations (factions), which were from time to time formed by other members or within functioning of its Board of Directors.
However, we believe that our Union goes beyond the previous purposes, making suggestions to the State under the pretext of defending human rights. Judges and prosecutors defend these rights in the exercise of their judicial functions and within the strict framework established in the Constitution and the laws.
The power of judicial officials has a starting point and a destination for the citizen. Your task is to restore social peace. A necessary condition for this is the consolidation of the sense of legal security, which is only achieved if the judge demonstrates impartiality and objectivity.
The representatives of the Union had an obligation towards their members to keep intact the image of impartiality and objectivity of their members and this obligation was not fulfilled.
The care of the sentence, which we impose, as well as the option to prohibit the meetings of more than one person in order to protect the good of human life and health in the midst of a pandemic, belongs to the state.

In addition, due to such issues, public counterclaims between members of the Board of Directors of the Union, who sometimes pronounce in vain in relation to the language imposed on the judiciary and prosecutors and in inadmissible tones, and the identification through them . With the specific political positions of the country’s forces, they rely on the moderation that the Judiciary has to show and on its traditions of independence.
For all of the above, proposing our obligation to preserve the prestige of the institution we serve, we strongly protest and urge that they refrain from such actions, which are certainly condemned by the majority of the Judiciary, in order to preserve the prestige and the unity of the Union, and avoid its weakening with the departure of its members in the future.
