The auditors of the Commercial Directorate of SDOE Attica have intensified controls during the difficult period we are going through (lockdown), in online stores (e-shops), focusing, in addition to the fight against fraud and the protection of the interests of the Greek state and the EU. – and protect the consumer public from unfair competition practices, both at the level of precaution and after consumer complaints.

Particularly:

Using relevant information, SDOE Attica’s Commercial Management conducted audits of companies active in the purchase and sale of mobile phones, video game consoles, tablets and laptops, and especially in the trade of goods and services carried out remotely by electronic means.

In these cases, money laundering was found, using fictitious invoices, and the legality of application of article 67 of Law 4484/2017, added to article 39 A of Law 2859/2000 (VAT Code) was examined. .) and consequently the undercutting of sales.

An audit was carried out on 3 legal entities that sold goods through online stores (e-shops), as well as on the companies supplying the mentioned stores.

From the investigation of our Service, it is concluded that the previous network of companies (carousel) operated methodically and in time, with the establishment of legal entities with managers or legal representatives, national or foreign natural persons that are extremely difficult to identify and have his characteristics ‘missing trader’.

The aforementioned circuit was intended to make sales through online stores, and the taxes that had to be compensated and, in fact, not reimbursed, through the trick of obtaining fictitious invoices for the expenses of nonexistent suppliers.

In addition, with their actions, the controlled companies distorted and created conditions of unfair competition against other legal companies in the field of marketing and distribution of mobile phones and other electronic devices, since it was observed that the controlled companies could sell the goods at prices extremely low (below cost). ).

The actions of the aforementioned companies meant a loss for the Greek State of more than 8,500,000 euros solely due to non-payment of VAT. for the years 2018 and 2019, while it is estimated that the total loss for the Greek State amounts to more than 15,000,000 euros.

The investigation continues on the participation of other companies that received invoices from the non-existent companies that issued fictitious invoices.

The Commercial Directorate of SDOE Attica will inform the AADE Services for the imputation of the evaded taxes.

The participation of three local people as cover-ups for the actions of the mentioned companies is investigated, as well as the managers-representatives of the controlled companies.

The investigation extends to the actions of natural and legal persons in other Member States, with the aim of gathering sufficient evidence to dismantle the network.
A relevant file will be sent to the Athens Public Prosecutor’s Office.

The Commercial Directorate of SDOE Attica calls on consumers to be very careful when choosing companies that operate through the Internet in the sale of products and, in any case, to request the necessary tax information.
