It is recalled that the measure of suspension of employment contracts was in force until October 31 for some industries and in particular for food, tourism, transport, culture, sports. Now government personnel are extending the November measure to all companies included in the April 500 KAD list. Employers can suspend part or even 100% of their employees.

In the event of suspension of the contract throughout the month, the company presents only a declaration of suspension in the information system “Ergani”. In case of suspension for more than one period within the month, the company files as many declarations as the intervals.

Unilateral seasonal and in October

As Mr Vroutsis revealed yesterday, seasonal tourism workers will be able to submit unilaterally responsible declarations to “Ergani” by October, to receive the 534 euros of the special compensation. These are employees with compulsory reemployment right in hotel and tourist accommodation companies, as well as tourist buses, which operate seasonally. Starting in November and for 3 months, they will be able to enter the OAED unemployment fund, with 50 stamps in the 2020 season.

Mandatory telework

Along with the suspension measure, it will be executed for the whole of November, the mandatory telework measure in 50% of the employees who can work remotely in the public and private sector.

All employers in Greece, whether active in a “yellow” Region or in a “red” Region, the employees who will carry out a mandatory telework for November are required to preannounce in the “Ergani” information system, in order to cover the required ceiling of 50%. The electronic announcement must be made in the immediate future.

All companies must complete and submit Form 4.1 “Declaration of Distance Learning – Special Purpose Form”. This special form with which employers will proceed to declare compulsory teleworking, is already available in the “Ergani” information system. Those who do not implement the measure are at risk with a fine of 3,000 euros.

Employers can switch employees to mandatory telecommuting in November, p. Eg per week, every 15 days and so on. In this case, employers have the opportunity to modify Form 4.1 according to the needs of the company.

The mandatory teleworking system is applied only in cases where work can be provided by remote employees and at least 50% of the total number of employees that can be employed by this system. Activities in which there is an objective impossibility of teleworking are excluded and in particular:

  • schools and in general the educational structures of the Ministry of Education,
  • hospitals and health facilities in general,
  • the pharmacies,
  • food supermarket companies and
  • messengers.

50% is taken into account when calculating the number of people actually employed in the company’s facilities, whose work can be provided remotely. It goes without saying that employees whose contracts are suspended, as well as employees who are on any type of legal leave (such as maternity, illness, etc.) are not taken into account. The provision also applies in cases of employees whose working time is divided into office work and outside work, and only to the extent that office work can be provided remotely.

For example: in a trade with 80 workers and 20 clerks, 50% is calculated on the 20 clerks and the trade is required to employ 10 employees.

In case the 50% percentage calculation results in a decimal number of 0.50 or more, it is rounded up.

2-month extension of unemployment benefits

All OAED unemployment benefits that expire or end in months are extended for 2 months September, October, November and December. That is, those who have completed the subsidy within those 4 months are now entitled to receive another two months unemployment benefits.

The two-month extension corresponds to the following amounts:
