Mitigation for those convicted of joining a criminal organization who have not been convicted of another crime

Headquarters prosecutor Adamantia Oikonomou suggested that all those convicted of joining a criminal organization, who were not found guilty of another crime, be granted relief in the Golden Dawn trial.

His proposal does not concern the 7 former gold deputies who were convicted of running a criminal organization.

Previously, the prosecutor had proposed the recognition of mitigation to 3 former deputies, Boukouras, Koukoutsis and Alexopoulos.

As he said, if they have not committed any other criminal act, the attenuation provided for in article 187 para. 6 of the old Penal Code can be recognized.

After their first proposal, the attorneys for the other defendants returned and asked their own clients for recognition of this attenuation.

What does the Penal Code establish for sanctions

Under the Penal Code, Nikos Michaloliakos and the six other former members of the neo-Nazi group who were found guilty of leading and joining a criminal organization face sentences of five to fifteen years.

For the members of the organization, the recognition of mitigations reduces the penalty from 5 to 10 years to 1 to 5 years.
