The recognition of mitigations to all the defendants who were found guilty of misdemeanors but also to those who were found guilty of joining a criminal organization, was finally proposed by the Office of the Prosecutor of the headquarters. Adamantia Oikonomou.
The prosecutor improved her initial proposal to mitigate circumstances after the deuterology of the defense attorneys, proposing the recognition of the mitigation of her previous honorable life (as defined by the old Penal Code that was modified in June 2019) for the following defendants :
– Those who are guilty of faults
– Those who are guilty of joining a criminal organization, but who are not involved in serious criminal activities, such as the murder of Fyssa and others.
Initially, the prosecutor requested that the attenuation of legal life be recognized (as the new code says) only for the former deputies accused Efstathios Boukouras, Dimitris Koukoutsis Y Chrysovalanti Alexopoulos. For the rest of those convicted, the prosecutor requested the rejection of all mitigating circumstances.
The prosecutor argued, among other things: “It would be contradictory on the one hand to recognize that they are directed against the democratic state and society as a whole and, on the other hand, to grant them relief. I propose the rejection of all applications ”.
However, after the deuterologies of the lawyers and the presentation of new applications based on the old penal code, the prosecutor’s proposal changed. But his proposal does not apply to those guilty of running a criminal organization.
The judicial decision is awaited.
