The biggest winners are expected to be retirees from the private sector.
Retroactive payments are expected to be made within October and specifically from the 15th to the 26th of the month, with the exact date ending in the immediate future. The amounts will start from 550 euros and will exceed 7,000 euros for very high pensions. It should be noted that, in addition to being retroactive, gifts also remain accessory.
The biggest winners are expected to be retirees from your fund. private sector who will receive back during the 11 months the amounts of 2 cuts: The 12% reduction for main pensions greater than 1,300 euros and the reduction of 5 to 20% for pensions or the sum of pensions greater than 1,000 euros. You will only receive retroactively the reduction from 5 to 20% State pensioners, ΟΤΑ and ΝΠΔΔ.
According to ert.gr, an amendment presented since Friday, provides for the return of the main retroactive pensions of the unconstitutional cuts of 2012 for the 11 months July 2015 – May 2016, with the clause that they are amortized for those who perceive possible future claims of retroactively for gifts and auxiliaries.
The conditions:
To receive a retiree retrospectively in October you must meet two basic terms:
You must be a former pensioner, that is, have submitted your retirement application before May 13, 2016 and have had in 2012 or when you retired (in any case before May 2016) a sum of main and auxiliary pensions greater than 1,000 gross euros.
All the rest, that is farmers of ex OGA, low-income retirees Ika that did not reach 1,000 euros etc. they don’t have to wait for anything. Because rebates apply only to primary pensions and not to suppressed or ancillary gifts, there are 1.5 million low-income retirees outside of rebates.
Instead they have to receive a million retirees with a sum of principal and auxiliary superior to 1,000 gross euros. The higher the retiree’s gross retirement income, the higher they will receive retroactively.
The amounts calculated for the beneficiaries
The retrospectives that will be paid will be at two speeds. All will be reimbursed the unconstitutional reductions of the 11 months that mediate between the previous decision of the SC and the publication in its Official Gazette. Katrougalos Law, that is, the period between June 11, 2015 and May 13, 2016.
However, the amounts of an unconstitutional cut will be reimbursed to state pensioners, those of law 4093 of 2012, while the amounts of two unconstitutional cuts will be returned to pensioners from the private sector, those of laws 4093 and 4051 of 2012. and the Court of Accounts on the constitutionality of Law 4051 of 2012. Therefore:
350,000 retirees from the private sector You will receive the amounts of 11 months corresponding to 2 reductions and in particular the 12% reduction in the part of the main pension that exceeds 1,300 euros (law 4051/2012), as well as the reduction of the main pension on a scale of 5 %, 10%, 15%, 20% for accumulated amounts of 1,000, 1,500, 2,000 and 3,000 euros in the sum of principals and auxiliaries respectively.
750,000 state retirees You will receive back the amounts of 11 months corresponding to 1 reduction and specifically the “scissors” 5%, 10%, 15%, 20% for accumulated amounts of 1,000 euros, 1,500,000 and 3,000 in the sum of principals and auxiliaries respectively .
For this reason, public pensioners with a main pension greater than 1,300 euros will receive lower amounts than pensioners in the private sector with the same pension amount.
For example, an IKA pensioner with a main pension of 1,500 euros will receive around 3,800 euros, while a public pensioner with the same pension will receive 3,100 euros.
An IKA pensioner with a main pension of 1,800 euros will receive about 4,700 euros, while a public pensioner with the same pension will receive 3,500 euros.
Amounts by category
- IKA pensioners will receive from 600 to 4,500 euros
- Public retirees will receive from 1,200 to 5,000 euros
- DEKO retirees – banks will receive 1,200 to 8,000 euros
- The retired self-employed will receive from 600 to 2,600 euros
- Retired self-employed scientists will receive between 1,200 and 6,000 euros.
The average amount for all is 1,300 to 1,500 euros.
Those who had a pension sum in 2012:
- 1,100 euros are expected to receive around 550 euros
- It is expected that between 1,100 and 1,500 euros will receive about 800 euros
- It is expected that between 1,500 and 2,000 euros will receive about 2,600 euros
- 2,000 – 3,000 euros are expected to receive about 5,500 euros
The large amounts that reach and exceed 7,000 euros mainly affect retirees with a total pension of more than 3,000 euros in 2012. These are mainly double retirees who receive two or more main pensions (for example, widowhood and old age or two retirees with the same right of the public and private sector, etc.) and senior retirees from IKA, DEKO – Banks and State who had high and very high pensions in 2012.
This is how flashbacks will be taxed
The amounts of the retroactive will be for everyone – pensioners of the private sector and the public sector – inviolable and not guaranteed by the State or third parties, in the form of repeal of each general and special provision, they are not linked and compensated with certified debts with the Tax Administration and the Government. Municipalities, Regions, Insurance Funds or Credit Institutions.
The amounts will be delivered without withholding 20% of tax and a special solidarity contribution at source, as provided for income from salaries and pensions paid retroactively.
On the other hand, retroactive payments will be taxed under the general provisions such as income from paid work and pensions, and retirees who receive them must submit corrective tax returns for 2015 and 2016, to be taxed according to their income.
