The following was known from the Ministry of Labor (see the bill approved with the provision for mandatory telework 40%)
On 9/25/2020, Employers are obliged to previously announce to the personnel that they are obliged to contract remotely, completing and submitting to the PS INSTRUMENTS Form 4.1 “DISCLOSURE DECLARATION – SPECIAL PURPOSE FORM of section 2 of article 4 of the Law of Legislative Content 11.3 .2020 (AD 55 / 11.03.20).
The above system is mandatory for companies in the Attica region. only in cases where the work can be performed by remote employees (excluding the educational structures of the Ministry of Education and Religions, health service structures, pharmacies, food and courier supermarkets), at the rate of 40% of the total number of employees that can be employed by this system.
For the purposes of the benefit, which is the decongestion of public transport and workplaces, the calculation of the above percentage will take into account the number of people actually employed in the company’s facilities, whose work may be provided remotely, during the period period from 9/25/2020 to 10/4/2020. It is understood that the above employee calculation does not take into account employees whose contracts are suspended, as well as employees who are on any type of legal leave (such as maternity, illness, etc.).
Furthermore, for the same purpose, the provision applies in cases of employees whose working time is divided into office work and outside work, and only to the extent that office work can be provided remotely. In case the above percentage calculation results in a decimal number of 0.50 or more, it is rounded up.
Regarding the completion of the form Ε.4.1. The following clarifications are given:
one.Like a date Start remote working is indicated by 9/25/2020, while as a workplace the workplace of the employee.
two.The remarks field indicates the total number of company employees, who can work remotely.
3.In the event that the company’s remote personnel change, in the START AND END TIMES column, WORKING DAYS, the days that the employee lends his work remotely, within the defined period of time, are listed. In the same context, employers have the opportunity to modify Form E..4.1., Depending on the needs of the company.
Four.In the case of companies in the Attica Region, which already apply the remote work system by decision of the employer for all or part of their staff, in accordance with case a) of section 2 of article 4 of 11.03.2020 PNP, There is a prior obligation to previously advertise 40% of its staff for the period from 9/25/2020 to 10/4/2020 and not the submission of Form E..4.1. accounts.
As of 10/5/2020, the obligation to submit Form E.4.1 returns. accounts, that is, within the first ten days of the month following the implementation of the measure.
5.If the calculation of the percentage of 40% of staff who can work remotely results in a number of 200 employees or more, companies can submit form E..4.1. until 9/28/2020 with the remote work system start date 9/25/2020.
This action does not impose sanctions of the law.
