At the same time, by decision of the Minister of Justice Konstantinos Tsiaras The validity of the procedure for the adjudication of cases of granting consent for the consensual registration of a mortgage promissory note and its revocation is extended until 10.31.2020, according to which the hearing will be held in writing, and the parties will appear before the court with a declaration. In other words, the possibility for the courts to adjudicate consensual notes without the presence of the parties extends until October 31, 2020.

Likewise, with a reform presented by the Ministry of Justice to the bill of the Ministry of Health, the operating regulations of the country’s courts and prosecutors, which were in force during the temporary suspension of their work, are applied until 12.31.2020 with successive joint. ministerial decisions, given the emergence of COVID-19 and the need to limit its spread.

In particular, for the Council of State, the Court of Accounts and the ordinary Administrative Courts, the term of 7 days from the discussion for the presentation of the legalization documents and the presentation of a receipt is valid again.

Especially for the Council of State, the Court of Accounts and annulment disputes that are resolved before the ordinary Administrative Courts, the above term also applies to the presentation of a memorandum. With regard to civil courts, for the period between 16.9.2020 and 31.12.2020, the following is provided:

(a) the redefinition at home of the hearing of any case that was canceled during the suspension of the courts due to the pandemic, as well as the form of notification of the new trial;

(b) the division of time within the same day of all the cases registered in the panel or evidence, in order to avoid conciliation and the possibility of postponement without charge, during the report of the case by the panel or corresponding evidence on the day of the trial without representation of attorneys at the hearing,

(c) the possibility of declaring to the Secretary of the Court by email that not all parties wish to be questioned by a witness during the hearing, so that the hearing of their case can begin at the beginning of the panel or evidence;

(d) the automatic extension, until a new trial, of the validity of the precautionary measures and provisions of the decisions on a request for suspension of execution or enforcement;

e) the possibility of obtaining affidavits from a lawyer;

f) the non-imposition of litigation interest during the suspension period (13.3.2020 – 31.5.2020) and

g) the domiciliary redefinition of the cases that were canceled during the period from 9.3.2020 to 12.3.2020, due to the fire that broke out on 9.3.2020, on the ground floor of the Athens Magistrates Court building, as well as a provision for the electronic means of notification of the new court.

The criminal courts have the possibility of submitting various requests and memoranda by email, the possibility of electronic transmission to the parties of a copy of the prosecutor’s proposals as well as the electronic way of notifying the parties for the discussion of previous requests. , which are carried out without the presence of the applicant.
