In the spring of a crown outbreak, 47 residents of Wolfsburg Hanns-Lilje-Heim died. After almost nine months of investigations, the Braunschweig prosecution now wants to stop the process. Criminal conduct could not be determined. I learned that WDR, Ed and “Süddeutsche Zeitung” (SZ) from legal circles and family members who had approached the authorities.

The disaster at the diaconal center for people with dementia made international news in March and April. Of the roughly 160 residents, 112 were ill from Corona at the time, 47 of them died. More than 40 nurses were also infected.

Evaluation of all medical records

A Wolfsburg lawyer had filed a criminal complaint and justified it with alleged references to catastrophic hygiene and working conditions at home. The accusations were widely accepted in many media and contributed to the image of the facility as a “home of terror.”

The wrongful death prosecution was directed against the president of Diakonie Wolfsburg, who is the sponsor of the house. It was argued in court whether the treatment of corona cases at home was illegal, even by omission. The prosecution not only interviewed relatives and nurses, but also evaluated all medical records.

Relief for nursing staff

In comparable cases, investigations were stopped after a few weeks if no obvious misconduct was evident. The Braunschweig court spokesperson had repeatedly argued that such a tragedy was due to everyone involved getting to the bottom of all the allegations and thus ultimately helping to distinguish between justified criticism and untenable accusations.

in a ARD-The documentation showed the caregivers the stigmatization that these accusations had at home. Consequently, Hanns-Lilje-Heim employees were relieved in view of the anticipated suspension of the criminal proceedings: “It is now clear that we were unfairly ridiculed,” says a nurse. A colleague added: “It’s nice if we don’t have to carry this pressure with us in the new year.”

The lawyer and relatives who filed the criminal complaint against the Diakonie now have two weeks to oppose the setup. Only then can the procedure be completed.
