The European Central Bank (ECB) wants to ignore the recent ruling of the Federal Constitutional Court. SPIEGEL learned from central bank circles that it was up to the Bundesbank to better inform German public and political institutions about its decisions.
Initially, ECB Director Christine Lagarde had planned to accommodate the Federal Constitutional Court, which had asked for better reasons for the ECB’s decisions last week. But under pressure from representatives of Italy and France, meanwhile, it has taken a confrontational course. The Federal Constitutional Court has nothing to say to the ECB due to lack of jurisdiction, argues the central bank; it is only subject to the Court of Justice of the European Communities.
EU Commission President Ursula von der Leyen is considering an infringement procedure against Germany due to the ECB decision. “The point is that we now have a dialogue on how we can ensure that this trial does not send the wrong signals regarding the primacy of European law and European jurisdiction,” von der Leyen told SPIEGEL.
