Augsburg (AP) – In the trial for the death blow of a 49-year-old man on Augsburg’s Königsplatz, the 17-year-old defendant will be sentenced to six years in prison at the will of the prosecutor and the co-defendants.
It is considered proven that the young man gave the fatal blow on the night of Saint Nicholas Day 2019 in search of dominance, the prosecutor said on Thursday in front of the juvenile hall of the Augsburg regional court. The 49-year-old firefighter died shortly after from a brain hemorrhage as a result of the blow. The defense asked for a suspended sentence.
“It was not fear, it was not the will to defend oneself,” said the prosecutor in his request for the imposition of the juvenile sentence. When the 49-year-old man was on the ground, the young man and two other teenagers beat a friend of the man and seriously injured him. “The lesson was, where is the next opportunity?”
A surveillance camera in the square, which is considered the focus of crime in Bavaria’s third-largest city, recorded the acts of violence. The 17-year-old confessed to the fatal blow right at the start of the trial.
However, from a defense point of view, he cannot be punished for it: he wanted to protect a friend whom the 49-year-old had previously encountered. “It’s an attack for me,” said one of the defenders. Legally, the punch was therefore emergency aid. The suspended sentence was the result of the dangerous assault on the man’s 50-year-old friend.
With the 17-year-old, the two men, 18 and 20, who were allegedly involved in the attack on the 50-year-old, are also sitting in the dock. The prosecutor requested the suspension of the sentence in accordance with the criminal law of minors. The 20-year-old, who had turned himself in to the police, was the least involved: although he had demonstrably tried to strike, he did not meet the 50-year-old.
According to the prosecutor, what remains after the main hearing is the harrowing question: “Why?” The fact that the 17-year-old did not reflect on his deed during the months of pretrial detention shows his “screamingly stupid” boast to his fellow prisoners: “I already killed someone.” The defense, however, emphasized how much the young man suffered from being stigmatized as a “killer firefighter.”
The accessory accusation coincided with the statements of the Public Ministry: both the wife and daughter of the murdered 49-year-old man and the 50-year-old who was seriously injured in the beating continue to suffer massively. In a letter from his wife, which his representative read, he said: “With his death, a part of me also died.”
In the case of the 18-year-old and the 20-year-old, however, the 50-year-old victim’s representative came out in favor of imprisonment rather than suspension of sentence: his client still suffered from facial paralysis due to the “orgy of violence “.
The trial ended with the defendants’ last words. The 17-year-old, who had previously remained silent, said he did not want what happened and wished the relatives great strength. The other two defendants also apologized. The verdict will be pronounced on Friday (10.30 am).
