A central accusation made by Thomas Hitzlsperger against Claus Vogt is that the costs of the Esecon investigation would spiral out of control. Vogt, however, argues that costs are largely covered. We give details.

Stuttgart – At VfB Stuttgart, a power struggle between CEO Thomas Hitzlsperger and President Claus Vogt became apparent at the end of the year. A central point of the accusations made by Hitzlsperger are the “uncontrolled rising costs” which are said to have led to “the AG having to support the association to save it from insolvency”. In his response, Vogt contends that these costs are “largely covered” by insurance.

It is an insurance policy against cyber damages, such as those that can occur in the event of hacker attacks, loss or misuse of data, and other damage to virtual space. The insurance contracted by VfB Stuttgart several years ago with the Allianz Group is now effective because it also works in case of possible violations of the General Data Protection Regulation (GDPR), and this is the case when the GDPR officer intervenes, which is the VfB case is applied, as is investigating the data protection officer of the state of Baden-Württemberg, Stefan Brink.

The insurance is based on the so-called claim collection principle. Unlike traditional insurance, the day the damage was reported is relevant and not the day of the actual default. Because of this and because VfB Stuttgart reported the damages on the same day that the Esecon law firm received the mandate, the costs arising from the Esecon investigations are apparently covered by insurance. According to our editorial team, the sum insured is in the mid-six-digit range. The Esecon investigation has led to costs for the club of around 400,000 euros.
