The Schleswig High Administrative Court has struck down the so-called ban on tourist accommodation from the Corona hotspots. The court classified the regulation as illegal on Friday.

The court in Schleswig (Schleswig-Flensburg district) declared the suspension of the regulation in an urgent procedure until a decision has been taken on the main issue. The judges justified the decision by saying that they wanted to protect the accommodation establishments from serious economic disadvantage.

Violation of the right to equal treatment

Two hotel chains operating hotels in Grömitz and on Sylt had demanded the ban. According to the court, the fact that the accommodation ban only applies to tourists violates the right to equal treatment.

In light of the latest findings from the Robert Koch Institute, the spread of the coronavirus is increasing in private homes and in private gatherings, while infections in hotels are quite rare. In addition, unlike private rooms, hotels and lodging establishments have adequate hygiene concepts, so staying there is not a major cause of the spread of the virus, argued the court.

SH vacation is possible again without a negative test

For vacationers, this means from now on: you can consult the decision of the Oververwaltungsgericht and go on vacation to Schleswig-Holstein even without a negative Corona test.

At the request of NDR Schleswig-Holstein, the state government announced that it would take note of the ruling and that it would be taken into account when forming new opinions.
