Judicial decision: but without partial blockade in Madrid

Despite the high number of infections: State and regional governments in Spain do not always agree on measures to contain the coronavirus. In Madrid, a court has annulled the partial closure of the city and the surrounding regions.

The higher regional court of the Community of Madrid has lifted the partial blockade of the Spanish capital and nine other places in the region. The court ruled that the order of the Ministry of Health illegally restricts fundamental rights and freedoms.

Due to the increasing number of new infections, the central government ordered last week that residents of the Madrid area can only leave their homes for good reason.

The conditions went into effect on Friday evening and should initially apply for two weeks. They were less stringent than the measures taken during the first wave of spring, when residents were practically not allowed to leave their homes.

Regional government versus central government

However, the regional government considered that this measure was disproportionate and filed a complaint against the measures. Regional President Isabel Díaz Ayuso feared, among other things, negative economic consequences.

Now it could lift the barriers, but the central government can still appeal the verdict.

Regional President Ayuso had complained that the Socialist Prime Minister Pedro Sánchez was waging a “political war” against his Conservative government and illegally interfering with the powers of the regions.

Before the mandatory closure, the crown numbers in their region had improved significantly, not least due to the closure of smaller districts. In fact, the number of new infections per 100,000 inhabitants fell from more than 800 to 591 today in 14 days.
