The mask requirement in the Bundestag has just come into force, there are already problems. The AfD wants to take to court the measure ordered by the president of the Bundestag, Wolfgang Schäuble. The parliamentary group made the corresponding decision on Tuesday night.

“We want to clarify whether the president of the Bundestag can force us parliamentarians and our employees in parliament to wear masks,” said MP Stephan Brandner. The lawyer claimed that the use of mouth-to-nose protection was “highly controversial.” Also, there is no pandemic situation.

Keeping your distance from other people is completely sufficient. Those who want to protect themselves can do so. Forcing everyone indiscriminately, however, is disproportionate.

Brandner announced that he would call the Federal Constitutional Court to revoke the mask requirement for deputies. The administrative courts are responsible for the employees of the parliamentary group. Furthermore, his group wanted to check whether the immediate execution of the order is legal.

Violations are subject to a fine

Since Tuesday, there has been a general mask requirement in Parliament buildings. Anyone who does not comply should expect a fine. The protection at the lectern and when deputies are sitting in their seats in plenary or in committee rooms can be removed, but only if a minimum distance of 1.50 meters is maintained. AfD MPs sometimes violate the mask requirement in the Bundestag.

Previously, there was only one recommendation for the Bundestag to wear a mask. Parts of the capital currently exceed the threshold of 50 new infections per 100,000 inhabitants in seven days, which applies to a risk zone within Germany. Members of the Bundestag come to Berlin from all over Germany during session weeks. The general decree issued by Schäuble on Monday is valid until January 17.
