Joachim Herrmann: Our Basic Law attributes a very high value to freedom of assembly. We respect that out of full conviction of the rule of law. People also exercise this right. Around 150 meetings in Bavaria were registered for the weekend. They have told me about the vast majority: the organizers and the participants have met the requirements, the allowed number of participants, the requirement of a mask, the appropriate distances have been observed. Unfortunately, there were serious violations at Marienplatz in Munich (tz.de * reported, editor’s note) and at Nuremberg in Lorenzkirche.
So why didn’t the police cancel the event in the middle of Munich?
Forcing the assembly to close, according to the police, would have resulted in increased confinement and physical contact. This would also have left non-involved pedestrians at risk of infection. That did not seem proportional to command and control, I think the bottom line was that the police acted correctly.

Did the city of Munich approve of the demonstration with too much credulity?
In any case, we have to say that there has been a second time in Munich with the same applicant for the meeting. The participant limit was again exceeded many times. The distance was not deliberately kept, even towards the completely uninvolved bystanders who just wanted to buy. The plaintiff had no control over their meeting. The police will have to discuss all this with the district administration department very thoroughly.
Your wish: better no demonstration at Marienplatz in the future?
In any case, we will analyze this very carefully. Whenever possible, such demonstrations should be held clearly separate from those not involved. The rule of law cannot accept such dangerous cruelty.

Will the police crack down next time?
There is a need for clearer guidelines in advance on how such a demonstration can be carried out. Here, the state capital is also clearly required to develop a corresponding concept. The police can implement such a concept if necessary.

We only intervene when there is dangerous and aggressive behavior towards others. We watch closely when radical groups try to cook their soup on the theme of the crown. But you also have to see: these people are only a small minority. All surveys show that the overwhelming majority think that federal and state governments have reacted to this life-threatening virus.
Saturday came in Berlin Baden-Württemberg and Bavaria thousands of people against the Crown measures on the street. Many ignored basic protective measures, such as the necessary distance. Not only for this, there are photos that “make you doubt your mind,” commented the Munich Merkur *.
Demonstrations against the crown measures of the federal and state governments also caused problems in other federal states over the weekend: thousands of protestors moved in Stuttgart, right-wing slogans were also heard in Saxony.
