Conservative Amy Coney Barrett will become the new Justice of the United States Supreme Court, according to Donald Trump’s will. Democrats are dismayed and fearful for the legacy of Barack Obama.
Despite protests from Democrats, US President Donald Trump nominated Conservative Justice Amy Coney Barrett for the Supreme Court vacancy a few weeks before the election. Trump announced his decision in Washington on Saturday. Barrett, a 48-year-old Catholic, is likely to succeed the recently deceased liberal judge Ruth Bader Ginsburg. Conservative Supreme Court justices would have a majority of six to three seats in the future. Barrett is highly respected in the field of Christian conservatives, one of Trump’s top voters.
“Today I have the honor of nominating one of the brightest and most talented minds in our legal system to the Supreme Court,” Trump said at a ceremony in the Rose Garden of the White House. Barrett appeared at the ceremony with her husband and seven children.
Shift right into America’s highest court?
Trump’s Democratic challenger Joe Biden reiterated his demand that the winner of the November 3 presidential election determine who will succeed him in Ginsburg. According to polls, Biden has a chance of winning the election. Democrats fear a shift to the right in the Supreme Court and thus potentially in American society as a whole. These are highly controversial topics such as abortion, religion, guns, and gay rights.
The United States Senate has the final word on the nomination. Republicans hold 53 of the 100 seats there. At least four of his senators would have to defeat Democrats to block Barrett’s confirmation. So far, only two senators have stated that a nomination should not be decided until 2021. Trump said Senate Judiciary Committee hearings to confirm Barrett’s should begin Oct. 12.
Democrats also want to warn Barrett because they fear that the health insurance law passed in 2010 under Trump’s predecessor, Barack Obama, Republicans want to reverse. The Supreme Court dealt with Obamacare in an oral hearing shortly after the election. “Judge Ginsburg should turn around in her grave in heaven when she sees that the person she is choosing seems to have the intention of undoing all that Ginsburg has done,” said influential Democratic Senator Chuck Schumer.
Opponent of abortion
The judges of the Supreme Court are appointed for life. Thus, Trump could cement a clear conservative majority there, possibly for many years. During his tenure, he has already filled two seats with candidates of his choice.
Barrett was nominated by Trump in 2017 for a position on the federal appeals court in Chicago. Opponents of a stricter abortion law fear that the avowed Catholic, as a constitutional judge, will vote to overturn a 1973 Supreme Court ruling that established the national right to abortion.
As his role model, Barrett appointed Supreme Court Justice Antonin Scalia, who died in 2016, who is considered one of the most powerful conservative justices in recent United States history and whose assistant was Barrett. Scalia had an “influence that should not be overestimated” in his life, he said. “His legal philosophy is also mine: a judge must apply written law. Judges are not political.” Barrett would be only the fifth woman on the Supreme Court and its second youngest member in history.
