From mid-October the following applies in Hamburg: all restaurants must be closed between 11 pm and 5 am Failure to comply could result in a fine of 5,000 euros. In the case of a Hamburg bar operator, the administrative court has initially canceled the curfew. The higher administrative court then decided differently.
The owner wants to make sure he can leave his three restaurants open after 11pm on weekends. Pubs are frequented mainly by regular guests. It is not a problem to observe the hygiene rules with these, he argued. The administrative court initially agreed. In fact, in this host’s case, the curfew is a disproportionate restriction.
At the request of the city, the Superior Administrative Court was lit. There it was decided: The curfew will continue for the moment. The provisional ruling published on Thursday establishes that the curfew rules will remain pending a decision on the complaint and that the owner must respect the prohibition of opening. Starting Monday, restaurants have to close anyway.
