Court annuls ban on demonstrations: police and senator promote radicalization of bourgeois protesters – politics

It is sentences like these that Interior Senator Andreas Geisel (SPD) and the Berlin police clearly put in place: There is no immediate danger to public safety other than a government ban on demonstrations against anti-crown measures. federal and state. justify. This is what the Berlin Administrative Court decided on Friday.

The risk forecast made for the ban does not meet the constitutional requirements. The ban is illegal and flawed.

The police have lodged a complaint with the Higher Administrative Court. And everything can be very different. But the right of assembly is a valuable asset, and any restriction of this elementary right in a democracy must be well founded.

And that is exactly where the problem lies. It certainly can seem very unreasonable when thousands of people take to the streets against Corona’s measures, deliberately ignoring the rules, denying the virus, and even suspecting a conspiracy behind it. And it’s no wonder right-wing extremists and anti-Semites are jumping in. All of this is unbearable and disgusting to most.

But the joy that the state is finally taking action and simply restricting freedom of assembly through a ban shouldn’t wash over Democrats. On top of that, the law applies. The reasons given by the police, certainly not without the political influence of the senator of the Interior, are not sufficient for a ban.

The senator of the Interior does not do his job

The judges decided that the authorities should have done more to do this. Especially since the Senate itself in its containment ordinance accepts the risk of infection in meetings and does not even prescribe protective masks. And the police should have thought for themselves how the risk of infection can be minimized by specific requirements.
