It is sentences like these that Interior Senator Andreas Geisel (SPD) and the Berlin police clearly put in place: There is no immediate danger to public safety other than a government ban on demonstrations against anti-crown measures. federal and state. justify. This is what the Berlin Administrative Court decided on Friday.
The risk forecast made for the ban does not meet the constitutional requirements. The ban is illegal and flawed.
The police have lodged a complaint with the Higher Administrative Court. And everything can be very different. But the right of assembly is a valuable asset, and any restriction of this elementary right in a democracy must be well founded.
And that is exactly where the problem lies. It certainly can seem very unreasonable when thousands of people take to the streets against Corona’s measures, deliberately ignoring the rules, denying the virus, and even suspecting a conspiracy behind it. And it’s no wonder right-wing extremists and anti-Semites are jumping in. All of this is unbearable and disgusting to most.
But the joy that the state is finally taking action and simply restricting freedom of assembly through a ban shouldn’t wash over Democrats. On top of that, the law applies. The reasons given by the police, certainly not without the political influence of the senator of the Interior, are not sufficient for a ban.
The senator of the Interior does not do his job
The judges decided that the authorities should have done more to do this. Especially since the Senate itself in its containment ordinance accepts the risk of infection in meetings and does not even prescribe protective masks. And the police should have thought for themselves how the risk of infection can be minimized by specific requirements.
It is not the first time that the police, here with bans on demonstrations, have acted politically, that is, for the SPD politician Geisel. Even when a right-wing elevator was banned on symbolic November 9, 2018, Geisel crashed.

However, as the head of a constitutional department, he must also guarantee the freedom of expression of those whose opinions are deeply repugnant to him and others. Is Andreas Geisel up to the task? Are you tall for it? Rather, act like someone who gets applause for being on the politically correct side. But that’s not your job in this office.
An even bigger stage for crown skeptics
You have to ask the interior senator and the police if they have not really raised the spirits and also promoted the radicalization of the “bourgeois clientele” among the participants. In the end, they even secured a significantly higher number of visitors and a solidarity effect.
And finally, the ban shows how strategically weak and unpredictable the police and the senator from the interior are. Acting wisely is different, for example with extremely strict conditions and constant intervention in case of any infraction.
If this becomes illegal again, it would only have to be clarified later in court. They did not use this advantage, instead, the police and the senator raised the curtain for an even bigger stage for skeptics of the crown. What a mess.
