The administrative court of Baden-Württemberg has granted an urgent request against the ban on accommodation in the state. The accommodation ban is temporarily suspended in Baden-Württemberg with immediate effect, as the court announced Thursday in Mannheim. However, appeals can still be filed.
The court considered the interference in the fundamental right to freedom of movement disproportionate. The country could not prove that hotels and pensions are “drivers” of the infection, so drastic measures are necessary. It is also unreasonable for applicants to submit negative corona tests conducted up to 48 hours prior to arrival. There was no guarantee that travelers would be able to get a corona test in such a short time.
RKI: number of new infections higher than ever
