First urgent requests against confinement at the Berlin Administrative Court – BZ Berlin

Following the resolutions of the federal and state governments, which provide for the closure of restaurants and many leisure facilities, as well as the suspension of amateur sports leagues, the operators have taken legal measures.

The first urgent motions against the closure of restaurants, pubs and bars ordered for next week have been received in the administrative court of Berlin.

“As of now, there are four urgent motions related to the lockdown complex, which begins on Monday,” the court announced on Friday upon request. An additional 19 applications have been announced but have yet to be received. When a decision will be made on urgent applications cannot be foreseen at first.

Resolutions in Berlin

On Thursday, the Berlin Senate rejected the resolutions of Wednesday’s federal-state conference. The ministers-presidents of the federal states reached an agreement with Chancellor Angela Merkel (CDU) on broad restrictions on public life from 2 November.

Consequently, restaurateurs will have to close their interiors for at least four weeks starting next week, but deliveries will still be possible. Stores, schools and nurseries will remain open.

Also, only members of your own household and another household with a maximum of ten people should be allowed to stay in public. This is binding, violations of these contact restrictions would be sanctioned by the regulatory authorities.

Tipped curfew

After the curfew was introduced in Berlin, some innkeepers already succeeded with their demands. Under the early October regulation, only six, then seventeen other hosts could open longer.

The administrative court justified the decision with the fact that restaurants would play a subordinate role in the case of new infections compared to family or friends. The curfew was not necessary and illegal.
