The applicants come from the Recklinghausen district in North Rhine-Westphalia, which is above this mark. He had booked a vacation in the Ravensburg district.

The accommodation ban is temporarily suspended in Baden-Württemberg with immediate effect, as the court announced Thursday in Mannheim. However, appeals can still be filed.

The Lower Saxony High Administrative Court declared the accommodation ban illegal in an emergency procedure. The decision was final, the court announced Thursday in Lüneburg. The operator of a holiday park had filed a lawsuit.

Saxony is also lifting the accommodation ban for people from risk areas of Corona. The government announced this Thursday after a conversation with district administrators and mayors of the Free State. The regulation should apply from Saturday.

The Baden-Württemberg court considered the breach of the fundamental right to freedom of movement disproportionate. The country also failed to prove that hotels and pensions are the “drivers” of the infection, so drastic measures are necessary. It is also unreasonable for applicants to submit negative corona tests conducted up to 48 hours prior to arrival. It could not be guaranteed that travelers could have a corona test in such a short time (Ref .: 1S3 3156/20).

Kretschmann announces exception for business trips

A few hours earlier, the Prime Minister of Baden-Württemberg, Winfried Kretschmann (Greens), declared in the Stuttgart state parliament that he wanted to relax the accommodation ban. He said they would keep it in principle, with one exception. It must be kept for business trips. The exemption should apply until November 8.

In their meeting with Chancellor Angela Merkel (CDU) in Berlin on Wednesday, the group of heads of government was unable to agree on a uniform course on the issue of the accommodation ban. It should be discussed again after the fall break. However, the federal and state governments agreed to, among other things, expand the requirement for masks, limit the number of guests at private celebrations, contact restrictions in public spaces and a curfew for restaurants.
