The Offenburg prosecutor is investigating two doctors because they are said to have issued patients inadmissible certificates against the mask requirement. ARD magazine “Report Mainz” had previously reported on one of the two.

The Offenburg (Ortenaukreis) dentist and general practitioner are said to have attested to women and men without prior examination or medical discussion that they are not allowed to wear a mask for health reasons. The prosecution confirmed this Thursday the investigation “on suspicion of issuing incorrect health certificates.” In this context, doctors’ practice rooms were searched and evidence seized last week. At the dentist, data had been obtained from more than 100 patients, for whom a certificate had been issued indicating the mask requirement by simple request.

Doctors could receive up to two years in prison

According to the prosecution, the range of punishment for the crime attributed to medical professionals ranges from a fine to two years in prison. Patients could be guilty of an administrative infraction with a fine. The evidence is currently being evaluated, investigations to examine a sufficient suspicion are still ongoing, the prosecutor told SWR. Therefore, it is not yet clear at this time whether charges will be brought against the dentist. The investigation is expected to be completed by the end of this year.

Offenburg doctor sees no mistakes in himself

The dentist told the SWR that he had nothing to hide and had therefore provided the investigators with the files of his patients with medical certificates after clarification with his lawyer. In his letter to the SWR, however, he emphasized that he was issuing his certificates correctly and that “affected patients” continued to receive “correct certificates” from him.

Last week, the doctor himself had drawn attention to the searches of his practice rooms through various Telegram groups and announced that he was expecting an upcoming court date. To do this, “he will probably be able to turn to a specialist colleague for health risk assessment by wearing a mask (…) as support,” he wrote in messages posted on the courier service.

Undercover investigation with critical doctors in masks

“Report Mainz” reported in early July about doctors issuing certificates of the mask requirement without a medical examination or discussion. The reporters had covertly visited doctors in various federal states and received a certificate from them after they only stated that they did not want to wear a mask. Interested physicians support the “Doctors for Enlightenment” initiative on the Internet, which still requires the issuance of certificates against the mask requirement.

Offenburg doctor immediately testified that he masked the phobia

As alleged patients, the reporters also received said certificate from the Offenburg dentist. When confronted later, he justified his actions in front of the camera: “You said you can’t make friends with a mask. I was diagnosed with a phobia of oral masks.” The dentist added on camera: “There are a hundred reasons not to wear a mask. And there really is not a reason not to wear a mask in public.”

The Offenburg prosecutor’s office informed SWR that the initial suspicion against the doctor arose, among other things, from a report on “Report Mainz.”
