Court of Appeals fixes White House for diverting military funds in border wall construction


The Joint Appeals Court on Friday upheld the Trump administration’s plan to change military funding for border wall construction, overturning a lower court ruling.

5-1 U.S. in 2-1 decision. The Circuit Court of Appeals ruled that El Paso County and the non-profit Border Network for Human Rights did not oppose the administration’s plan to take લે 3.6 billion from more than 100 military construction projects. Neither plaintiff could prove that they were harmed by the scheme.

U.S. District Judge David Briones’s 2019 ruling overturned the decision.

Judge James Dennis wrote in his minority opinion in support of the county and the nonprofit that he could not join the majority because he believed the “2019 Consolidated Approval Act clearly prohibits redistribution of funds to the border wall.”

The Supreme Court has already agreed to review the ruling, with the 5th Circuit saying it disagreed and “would refuse to comply.”
