Uribe case: the reasons for the Supreme Court to reject the prosecutor’s challenge

The FM learned the full ruling of the Supreme Court of Justice decision that rejected the challenge presented by Senator Iván Cepeda against prosecutor Francisco Barbosa, to withdraw from the investigation for alleged manipulation of witnesses against former President Álvaro Uribe.

The Court notes that the fact that Barbosa had participated in the presidential campaign and the supposed bond of friendship with President Iván Duque, it was not a justified or valid reason to challenge him or ask him to withdraw from the process.

“It is not seen that this participation is sufficient to prevent the challenged official from adjusting his behavior to the legal system, especially if it is taken into account that the investigated is not the then presidential candidate ”, said the Court.

The high court also warned that Senator Cepeda, being a victim in that case, has several avenues in search of guaranteeing his constitutional rights, such as asking the Attorney General’s Office for special monitoring of the case.

“Interested parties may request special monitoring of a particular process (…) the possibility of requesting the review of the file and of opposing the estoppel or the application of the principle of opportunity, up to evidentiary requests and the possibility of filing appeals ordinary and extraordinary ”, said the Court about the possible possibilities of the victims in a judicial process.

Finally, the Court draws attention to Senator Iván Cepeda in the sense that could not attribute to the Attorney General actions or arguments used by the delegated prosecutors in the hearings on this issue.

On this point, the Court made reference to the hearing of charges against lawyer Diego Cadena and said that “there is no data to conclude that the Attorney General of the Nation, in some way, determined the content of the aforementioned charge.” .
