Two young men are sentenced for beating Sergio Araujo’s son – Investigative Unit

At around 10 p.m. on February 4, 2017, after what appeared to be a lively meeting of alumni of the Modern Gymnasium school, the young Simón Araújo Savi, son of the coastal politician Sergio Araújo (from the Democratic Center) received a brutal beating.

According to the file, the men who attacked him caused him a physical deformity, which permanently affected his face. Witnesses indicated that when a group of friends was preparing to leave the Sierras del Este complex, in the north of Bogotá, the fight began.

Although the case happened three years ago, justice has just made a substantive decision that coincides with another case that has impacted: the beating that received a 16-year-old boy (last October 23), by a group of six youths, who intercepted him in a park in the El Batán neighborhood of the town of Suba.

So far it is known that all the students involved in this event are part of two prestigious schools in the area: Vermont and English School.

In the case of Araújo, in seconds a discussion began over differences that arose over liquor issues, and the confrontation went from words to fists.

Simón Araújo says that when he arrived at the parking bay he saw that his friend Gabriel Noguera was being chased by a young man to hurt him and decided to intervene, remaining in the middle of the brawl.

According to him, he received a strong blow to the back of the neck, which knocked him down and a person appeared whom he identified as Javier Martínez Rodríguez (25 years old), who proceeded to hit him in the face. Araújo said that while he was beaten, Santiago Mantilla Calderón (24) had blood on his hands and prevented them from defending him.

Doubts and condemnation

The Araújo family took the case to the Public Prosecutor’s Office – through criminal prosecutor Jaime Lombana – and in mid-2018, an accusation letter was presented against Martínez, for intentional personal injuries, and against Mantilla as an accomplice. He relied on the statement of an expert, witnesses and photos of the injuries.

Through a patrol car, photographic examinations were incorporated, where the victim pointed out the accused.

The Prosecutor’s Office indicated that the testimony of the victim, Simón Araújo Savi, “was clear in narrating that on the day of the events, at approximately 10:00 at night, in the Sierras del Este complex, he suffered an attack, while trying to defend one of the friends with whom he was, specifying that Santiago Mantilla, chased his friend, to the ramp of the parking lot of the building, for which he decided
follow them. “

And the accusing body also affirms that “when his friend left the ramp avoiding Santiago Mantilla, he threw a fist at the victim (Simón Araújo Savi), that He made him fall to the floor and while he was on the floor, covering himself, he perceived two individuals hitting him, strongly on his face and head, specifying that after he falls to the ground, Javier Martínez begins to beat him along with SAntiago Mantilla, adding that later, he saw that Santiago Mantilla had blood on his hands, which was confirmed by the statement of Jorge Alberto García Contreras. He maintained that the victim recognized his aggressors and gave their physical descriptions, which are consistent with those of the defendants. “

Judgment

This is the sentence against the accused aggressors of Sergio Araújo’s son.

According to the Prosecutor’s Office, what the victim said was confirmed by eyewitnesses to the events: “firstly by the building’s security guard, Benjamín Bautista, who is an impartial witness, and who indicated that on the day of the events , in an unsuccessful attempt to deter an argument outside the building, such as about 15 meters away, he saw on the ramp of the building, a person, bald,
who was about 1.65 ” tall, thick and wearing dark clothes, who was on top of Simon, punching him in the face as he tried to cover himself,
so they went to help the victim and there they saw that he was bloody and that he had some teeth missing, which corroborates what the victim said “.

No background

Martinez’s defense said, in his favor, that there are “four versions” of the events and even that Araújo’s has contradictions about the attackers.

In addition, that the law indicates that when there is doubt, it must be resolved in favor of the accused. Y that the injuries could not be classified as permanent, because with proper treatment their normality can be restored.

He also alleged that initially the charges against those involved and the alleged division of roles to beat Araújo were not specified. And that the photographic recognition was illegal.

For their part, Mantilla’s defense alleged that although he could have hit him on the back of the head, they did not cause the injuries to his face. Also, that co-authorship was never proven.

But 4 days ago, the 23 criminal judge sentenced Martínez to 46 months and a fine of 49 minimum wages.

And Mantilla was sentenced to 22 months.

However, the conditional suspension of the execution of the sentence was applied to them for being less than 4 years and having no record: they can appeal.
