Judge 29 of control of guarantees of Bogotá legalized the capture of the police officers Harby Damián Rodríguez Díaz and Juan Camilo Lloreda Cubillos, accused of the homicide of the law student Javier Ordóñez.

The judicial official considered that the detainees had their fundamental rights respected during the arrest procedure.

The Prosecutor’s Office, accompanied by the Attorney General’s Office and the representative of the victim’s family, had requested that the raids carried out and the capture of the two soldiers be declared legal. Lawyers for the policemen had made requests to the contrary.

However, the judge in the case agreed with the prosecuting body and endorsed the detention procedures for the crimes of aggravated homicide and aggravated torture.

He added that the decisions of the Prosecutor’s Office were proportional and reasonable in the context of a criminal investigation.

He emphasized that the procedures did not affect the rights of the relatives of those captured or of the people who were in the place where Rodríguez Díaz was captured in the Bosa sector in the south of Bogotá.

“There was no excess of the Judicial Police,” said the judge.

The judge suspended the hearing and summoned for ten in the morning of this Saturday in order to advance with the hearing of imputation of charges.
