The Prosecutor’s Office presented before a judge of guarantees Julián Valente Ortegón Mosquera accused of the crime of the 21-year-old Ana María Castro, in events that occurred on March 5, 2020 in Bogotá.
A case that caught the attention of researchers because It was thrown from a moving vehicle after a night of partying. The captured person faces the crime of aggravated femicide.
The prosecutor in the case maintained that urgent acts were carried out, a report on the arrest of the detainee and the way in which the arrest procedure was carried out.
“He refrains from going to Medicinal Legal, stating that he did not receive any mistreatment,” said the prosecutor Gerardo Ariza.
At the hearing, the defense lawyer said that the prosecutor did not make a legal support on how the capture was made.
“She was not caught in flagrante delicto, therefore it is the duty of the delegated official of the Prosecutor’s Office to be consistent with her request, to be consistent with the factual and legal. There is no such coherence here, ”said Rafael Gómez, defense attorney.
The Prosecutor’s Office had ordered that some judicial proceedings be carried out, such as an inspection at the scene of the events, a removal of the body, interviews to determine the proper time and instead of how the death of the young Ana María had been, which at first wanted to pass as an accident.
“There is no evidence that the use of force for the arrest has been exceeded or arbitrarily exercised; on the contrary, the treatment given was in accordance with the human dignity of the captured person and those conditions come in legality”, the judge pointed out.
The judge legalized the arrest of the accused, who did not accept the charges, and closed the hearing. Next Tuesday at six o’clock in the morning the Prosecutor’s Office will request the security measure of the captured in prison.
Accident or murder?
On the morning of March 5, Ana María Castro, 21, left a bar in the north of the capital in the company of the captured today Julián Valente Ortegón Mosquera and two other young men, with whom he apparently maintained a friendship, as established by the authorities.
“The technical body of the Prosecutor’s Office made effective the arrest warrant against one of those responsible for the death of the young Ana María Castro Romero, which caused anxiety in Colombian society,” announced the attorney general of the nation, Francisco Barbosa.
After leaving the place, according to the investigation, the four people got into a vehicle bound for an apartment in the Pontevedra neighborhood, Suba town. Ana María was in the back of the car. There, she was reportedly hit in the face and then thrown from the moving vehicle.
“This young woman was thrown from a vehicle on Calle 80 in the city of Bogotá, the fall of the vehicle caused injuries, including a cranioencephalic trauma that caused his death ”, assured Barbosa.
His mother had called the authorities on March 12, 2020 to clarify what happened.
“Help me clarify the death of my daughter, because my daughter, nor any human being deserves to die as she did. Let them talk, I need to know what happened to my daughter so that I can be calmer ”, claimed Nidia Romero, mother of Ana María.
The victim was registered in the assistance centers as unknown, due to the lack of identification documents. Later, it was her mother who was in charge of recognizing her.
