Those who sought out the JEP
In 2018, when the JEP opened case 003, which corresponds to the investigation of false positives, and began to call the military who sought to submit to that transitional justice to public hearings to avail themselves of alternative penalties in exchange for telling the truth, they began intimidation.
According to official information to which La Silla Vacía had access, until September of this year 24 military personnel -between active and retired- who decided to take advantage of this jurisdiction have requested protection due to security risks.
Of that total, in 20 cases the security studies have shown that there is an extraordinary risk and of those, in 18 measures have been issued to safeguard his life after it was determined that he is in danger due to “the information they possess and that they are contributing to the Special Jurisdiction for Peace, which involves not only the performance of the institutions, but also colleagues and superiors, as well as political actors.
La Silla learned of the cases of two of the proteges: Colonel Gabriel Rincón and Major Gustavo Soto, who were being prosecuted for false positives and, once they were admitted, gave information on 63 more facts of which they were aware and should be investigated.
According to Tania Parra Montenegro, a lawyer for the two officers, the threats were “raised specifically by handing over all the proceedings to the JEP”.
Colonel Rincón, who has testified five times at the JEP, was the victim of an attack at his home. Two men shot him in front of his house, but as he was opening the door he managed to protect himself.
Major Soto, according to his lawyer told La Silla, has been approached several times to change his testimony and on one occasion, when he was on his way to the supermarket, he was almost run over by two men on a motorcycle who told him “look at see if it is still a toad ”.
Lawyer Parra herself also assured that she has also been a victim of intimidation. On one occasion they tried to kidnap her minor son and on another her husband.
“With the child what happened was that the man of the route fortunately noticed that there was something strange and got off with him”, she said “With my husband what happened is that I was walking my mother-in-law in the park, who is in a chair on wheels, when two men in a car identified themselves as members of the Police and tried to take it up by force, but my mother-in-law did not take it away ”.
Parra, as well as his clients, among which are more military, also has protection measures.
