Although it is awaiting confirmation from the Supreme Court of Justice, it has transpired that the case in which the high court is investigating former President Álvaro Uribe Vélez will be transferred to the Attorney General’s Office.
The Investigation Chamber convened an extraordinary virtual chamber to continue the discussion of the legal future of the ex-president in the case of bribery and manipulation of witnesses for which he is being investigated. The foregoing, due to the fact that after Uribe’s resignation from the Senate of the Republic, his defense alleged that the Supreme Court lost jurisdiction and the Attorney General’s Office would be in charge of continuing the investigation of the case.
The magistrates in this chamber had already met several times to try to decide how they should proceed. However, they could not reach an agreement. This Monday it was known that the case will be sent, which links Senator Iván Cepeda as a victim, to the investigating and accusing body.
Iván Cancino, lawyer for former Senator Uribe, indicated that they have not yet been notified of the decision that was known in the last hours. However, this was one of the requests of Uribe’s defense, which has repeatedly questioned the impartiality of the high court.
Last week, the Attorney General’s Office warned that the Special Chamber of Investigation of the Supreme Court had to forward to the Prosecutor’s Office the file against the former senator, by which this same court ordered his detection on August 3.
At the time, the Public Ministry explained that with Uribe’s resignation from his seat in the Senate, the Court “lost the competence to continue with the processes related to common crimes.”
In dialogue with EL HERALDO, Cancino specified that all the cases that link Uribe in acts committed before he was a congressman will be transferred to the Prosecutor’s Office, without any type of debate by the Supreme Court of Justice. For example, cases such as the Aro Massacre, which binds him as the former governor of Antioquia, according to his defense, would become the responsibility of the investigating and accusing body.
In addition, he said that the cases that link Uribe in acts committed while congressmen should be examined independently.
