In a new hearing against the so-called murderer of the hills, Fredy Armando Valencia, the judge of the case decided to absolve him of the crime of violent carnal access.
Valencia has already been convicted of the murder of at least 10 women, whose bodies were buried on the slopes of the Monserrate hill. Faced with this decision, the Prosecutor’s Office, the Attorney General’s Office and the Victims Network appealed.
It should be remembered that Fredy Armando Valencia Vargas was acquitted once of the crime of violent carnal access by the 30th District Criminal Judge who argued in the last hearing that The evidence provided by the Attorney General’s Office is only indicative that the accused may have abused his victims before murdering them in the eastern hills of Bogotá, that is, there is a reasonable doubt.
At that hearing, the judge spoke of errors in the procedure and contradictions on the part of the Prosecutor’s Office, such as when it was said that Fredy Armando Valencia murdered his victims when they refused to have sexual relations with him.
“If he killed them when they refused to have sex, the question remains whether the women were abused or just murdered”said the judge.
He also said that eight autopsy reports were analyzed that revealed that some bodies were in a fetal position and in a state of undress, it is more that many showed what could be classified as evidence of a sexual crime such as the absence of clothing and injuries to their body .
However, he said that the Prosecutor’s Office did not report on relevant facts of the eight expert reports that proved that there was violent carnal access. And he added that there may be consistency errors.
Faced with this, the Prosecutor’s Office said at the time that it was going to file the appeal issued by the 30th Criminal Court of the Bogotá Circuit, with knowledge function, in favor of Fredy Armando Valencia Vargas. The Attorney General’s Office and the Victims Network referred in the same way.
The Office of the Attorney General of the Nation did not share at that time the assessment that the judge of knowledge made of the evidence presented in the advance trial against Fredy Valencia Vargas, for the crime of violent carnal access in homogeneous competition.
According to the investigating body, it should be remembered that This man was sentenced to 36 years in prison in November 2017 for the killings of 10 women on the Monserrat hill.e, who, before murdering them, are presumed to have consented carnally.
For the deaths the defendant accepted his responsibility, but for the sexual crimes he did not do so and the Prosecutor’s Office continued the investigation, with which the appeal to be filed is related.
Valencia Vargas, who was captured on December 1, 2015 on Avenida Circunvalar with Calle 20 de Bogotá, remains deprived of liberty in the Picota prison in Bogotá.
Today the judge’s decision to absolve Valencia of this crime was ratified again And for the same reasons, for him there are only suspicions that there was an associated sexual crime, that is, probabilities, not certainties.
